‘Arrests Cannot Be Made Solely Based on the Commission’s Report’ – Constitutional Expert Neelambar Acharya

Former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lalekhan have been arrested by the police on charges related to the ‘Jan-G’ movement. Constitutional expert Neelambar Acharya described the commission’s report as biased and one-sided, stating that arrests should not be made solely on its basis. He emphasized that an impartial investigation must be conducted regarding the incidents of September 9 (Bhadra 24) and that actions should be taken strictly according to the law.

Following the arrests of KP Sharma Oli and Ramesh Lalekhan, debates have emerged over the fairness and potential retaliatory nature of the process. The Gaurav Bahadur Karki Commission’s report has been accused of distinguishing events of September 8 and 9 (Bhadra 23 and 24) in a prejudiced manner. Acharya stated, “Arrests cannot be made solely based on the commission’s report. The government must use its investigative agencies to conduct inquiries.”

He added, “The loss of life is a tragic event. However, will the families of those who lost their lives on September 9 be denied justice?” Acharya stressed the necessity of an impartial inquiry into the incidents on September 9 as well. He noted, “There must be appropriate action against acts such as setting fire to houses, killing people, and stripping police uniforms.”

Acharya further asserted that the commission’s report cannot be accepted as evidence to pursue cases in court. He described it as “a biased, one-sided, and narrow-minded report.” He called for the establishment of a neutral commission, conducting impartial investigations, and taking action only if guilt is properly proven.
